J.K. Rowling has contested Scotland's recent hate crime legislation through a series of social media posts, daring authorities to arrest her if they deem her statements offensive.
The acclaimed author of the Harry Potter series, residing in Edinburgh, referred to several transgender individuals as men, including those with criminal records, activists, and public figures. She argued that the prohibition of accurately describing biological sex would signify the demise of freedom of speech and belief.
Prior to this, Scotland's First Minister, Humza Yousaf, emphasized the necessity of the new law in addressing a surge in hateful sentiments. The Hate Crime and Public Order (Scotland) Act 2021 introduces the offense of "stirring up hatred" based on various characteristics such as age, disability, religion, sexual orientation, transgender identity, or being intersex.
Notably, the legislation currently does not extend protection to women as a collective group. Rowling, a vocal critic of certain aspects of transgender activism, made her stance clear on the day the new law came into effect via a post on Twitter.
The Hate Crime and Public Order (Scotland) Act 2021, or as I have called it The Silence Act, is written as such that whatever you say online from your device anywhere in the world that is deemed hate speech under this Act is given equal weight as committing the offense in Scotland if someone in Scotland complains about what you posted.
I foresee two things that could theoretically occur: Scotland could request an extradition order or, barring an extradition request, can try you in absentia is a Scottish court.
Granted, I live in the United States and such an extradition request would be most likely denied, probably laughed out of court, but there is nothing stopping Scotland from trying me in absentia.
And then, maybe one day, I set foot on Scottish soil and quickly arrested the moment I step off the plane.
I want to ask you, My Lovely Readers, a favor: if it’s been over a week and I’ve not posted anything here, you can safely assume I’m sitting in a Scottish prison awaiting trial.
