A non-binary drag queen who had been working in a nuclear waste job in President Joe Biden's Department of Energy has been charged with felony theft after he allegedly stole a bag from the baggage claim at Minneapolis-St. Paul International Airport.
Sam Brinton, whose full title was as the DOE's Deputy Assistant Secretary of the Office of Spent Fuel and Waste Disposition, is accused of taking the bag in September. He’s currently on a leave of absence from his DOE job.
If found guilty he could now face five years in jail, a $10,000 fine, or both.
In a complaint from October 27, it is alleged Brinton was seen caught on airport surveillance cameras removing “a navy blue hard-sided roller bag” from a baggage claim carousel.
On the same day, the bag was reported missing by a woman earlier in the day.
After reviewing several surveillance videos, she identified the bag as hers adding that the total value of items in the allegedly stolen bag was roughly $2,325.
Video that has not been released to the public sees Brinton “removing the blue bag's tag and putting the bag tag in the handbag they were carrying and beating it out of the airport in a hurried manner.”
Brinton was in the airport having arrived on a flight from Washington D.C. where he lives but had not checked a bag for his journey.
Law enforcement quickly tracked him down with Brinton initially denying taking anything.
This is now considered a crime of moral turpitude, a legal concept in the United States and prior to 1976, Canada, that refers to "an act or behavior that gravely violates the sentiment or accepted standard of the community".
The classification of a crime or other conduct as constituting moral turpitude has significance in several areas of law. First, a prior conviction of a crime of moral turpitude (or in some jurisdictions, "moral turpitude conduct", even without a conviction) is considered to have a bearing on the honesty of a witness and might be used for purposes of the impeachment of witnesses.
Second, and most importantly, offenses involving moral turpitude may be grounds to deny or revoke state professional licenses such as teaching credentials, applications for public notary, licenses to practice law, or other licensed professions.
It is also grounds for Brinton to have his Q-level clearance at DOE revoked.
According to Sandia National Laboratories’ website, the Department of Energy (DOE) Personnel Security Program establishes requirements that ensure its missions are accomplished in a secure environment by men and women in whom both the Department and the American people may place their complete trust and confidence. An indication of this trust and confidence is a security clearance.
All individuals’ initial and continued eligibility for security clearances are adjudged against the Adjudicative Guidelines for Determining Eligibility for Access to Classified Information (National Guidelines).
The adjudication process is the careful weighing of a number of variables, known as the whole person concept, utilizing the National Guidelines. In evaluating the relevance of an individual’s conduct, the DOE will assess the disqualifying and mitigating conditions outlined in the National Guidelines, which take the following factors into account:
the nature, extent, and seriousness of the conduct
the circumstances surrounding the conduct, to include knowledgeable participation
the frequency and recentness of the conduct
the individual’s age and maturity at the time of the conduct
the voluntariness of participation
the presence or absence of rehabilitation and other permanent behavioral changes
the motivation for the conduct
the potential for pressure, coercion, exploitation, or duress
the likelihood of continuation or recurrence
I’d have to say that Brinton’s behavior in this matter has put that trust and confidence at risk if his kink activism hasn’t already.
You might believe that Brinton’s capacity to work at DOE has nothing to do with his kink activism, but he doesn’t share your belief. He believes that it is good and right to gain access to senior levels of government and use that access for advocacy.
As Jon Miller put it:

Brinton is a lot of things: non-binary, gender fluid and straight up into some really kinky shit he’s not shy telling you about: he is a “pup handler” - that is, a gay man who leads other gay men who pretend to be dogs.
Brinton would like the world to know that back then, his boyfriend could still pretend to be a dog when he sodomized the lad.
