District Attorney Suspended For Misgendering And Deadnaming James "Hannah" Tubbs
Tubbs Sexually Assaulted A 10 Year Old Girl In A Denny's Restroom, Now Accused Of Murder
Los Angeles District Attorney George Gascon has suspended the attorney who prosecuted a 26-year-old trans child molester who was accused of identifying as a woman only after DNA evidence linked him to a cold case unsolved murder, according to law enforcement sources.
Shea Sanna, who had been the lead prosecutor for part of the case, is accused of misgendering and "deadnaming" the convicted child molester James “Hannah” Tubbs, who is now accused of beating a man to death in the woods with a rock in Kern County.
Sanna has argued in the past that jailhouse phone calls show Tubbs, now 27, was using gender identity to game the justice system – an argument that sources say made others in Gascon's office uncomfortable and led to the suspension.
Sanna tweeted about his suspension on Friday.
Well, he’s right: the Gascon administration got played. Here now is Tubbs admitting he played them.
Back in 2014, James entered a women’s bathroom in a Denny’s where he promptly grabbed a 10-year-old girl by the throat, pushed her into a stall where he locked her in and proceeded to put his hand down her pants.
The thing is James was 17 at the time he committed this crime, was very much male and what should come as no surprise to the readers of this fine newsletter was that once the law caught up with him in Idaho (where he had eventually fled California to) he started identifying as female.
Because he identifies as female, he was tried, convicted and sentenced to a scant two years in a female juvenile detention facility where he doesn’t have to register as a sex offender upon release.
But on May 10, 2022, Tubbs was charged with murder and robbery in a separate case in Kern County's Lake Isabella.
A criminal complaint alleges Tubbs killed and robbed a man, identified as Michael Clark, in 2019. He was charged under his real name, the complaint shows.
Tubbs was arraigned Tuesday in Bakersfield and pleaded not guilty. Bail was set at $1 million.
In a memo issued in February 2021, Gascón noted that under his December 2020 directive that there is a "presumption that the office will not seek transfer to criminal jurisdiction" for juvenile offenders.
"However, in exceptional circumstances, criminal jurisdiction may be appropriate for youth offenders," Gascón wrote. "The selective transfers of juveniles to the adult court system will only be in the most egregious cases that warrant a state prison commitment, where it is abundantly clear the minor poses a danger to the public and has serious difficulty controlling their dangerous behavior in line with the evaluation for extended Secure Youth Treatment Facility detention."
A separate committee -- the Juvenile Alternative Charging Committee -- will review cases when presented with a recommendation from the prosecutor, the deputy-in-charge, the assistant head deputy and the head deputy of the Juvenile Division to proceed with a transfer hearing to adult court for cases originating in juvenile court.
